NO PURCHASE NECESSARY.
Your Own Montana Mountain Sweepstakes ("Sweepstakes") is offered and open only to legal residents of the United States and District of Columbia who are 18 years or older. Employees, officers and directors of the Montana Department of Commerce (sponsor), The North Face, Inc., Mariah Media Inc. (sponsor), and their respective parent, affiliates, subsidiaries, prize suppliers, advertising and promotion agencies, and the immediate family members (defined as current spouse as well as siblings, children and parents and their respective spouses; regardless of where they live) or members of the same households (whether related or not) of such employees/officers/directors are not eligible. Void in Rhode Island, Puerto Rico and where prohibited by law.
1. TO ENTER: (A) STORE ENTRY. Between October 1, 2006 and October 31, 2006, go to any participating retailer of The North Face products and obtain an official entry form. Complete entry form with your printed name, address, daytime telephone number, and e-mail address (if any). Deposit completed entry form in the specially marked entry box for receipt by close of business on October 31, 2006. If supplies of entry forms are exhausted, you may instead enter by printing the above-indicated entry information on a 3" x 5" card/paper along with "Win Your Own Mountain Sweepstakes" and depositing same in the entry box. No mechanical reproductions of entries will be accepted. OR (B) ON-LINE ENTRY. Between September 17, 2006 at 12:01 a.m. Mountain Time ("MT") and 11:59 p.m. MT on November 30, 2006, go to www.WinYourOwnMountain.com to register to win. On the Sweepstakes Page, complete and submit an on-line official entry form, with your name, address, daytime telephone number, and e-mail address. Between October 1, 2006 at 12:01 a.m. Mountain Time ("MT") and 11:59 p.m. MT October 31, 2006 individuals can go to www.thenorthface.com and click on The North Face – Win Your Mountain Sweepstakes button to access the Sweepstakes Page. On the Sweepstakes Page, complete and submit an on-line official entry form, with your name, address, daytime telephone number, and e-mail address. All on-line entries must be received by11:59 p.m. MT on November 30, 2006. No other form of Internet/email entry will be accepted. Note: If your jurisdiction does not have any participating retailers of The North Face products, you may only enter the Sweepstakes via www.thenorthface.com or www.WinYourOwnMountain.com. The North Face web site contains a listing of the names and addresses of all participating The North Face retailers in the U.S. or via www.WinYourOwnMountain.com. Limit one entry of any kind per person or e-mail address. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In case of dispute, on-line entry will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No responsibility is assumed by Sponsor for lost, late, damaged, incomplete, stolen, misdirected, illegible entries/e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions/failures; or for garbled, jumbled or corrupt transmissions; or for other technical error of any kind. Once submitted, entries become sole property of Sponsor and will not be returned.
2. WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by the Montana Department of Commerce the week of December 11, 2006. By participating, entrant agrees to these Official Rules and the decisions of the Sponsors, which are final and binding in all respects. Winners will be notified by e-mail, phone or mail (at Sponsor’s sole discretion) approximately 10 days after the drawing. No substitution or transfer of prize is permitted, but Sponsor reserves the right, at its sole discretion, to substitute advertised prize with another prize of equal value should advertised prize become unavailable for any reason. Limit one prize per family/address/household.
3. PRIZES/ODDS: Grand Prize (1) - a trip for 2 days/3 nights for the winner and five friends to have exclusive use of a ski mountain in Montana. Trip consists of round-trip coach air travel to Bozeman from major commercial airport near winner’s residence and residences of five guests (as determined by Sponsor in its sole discretion); accommodations to be provided for winner and their five guests. Also to be provided is exclusive use of a Montana ski area and meals for two consecutive days, for the winner and five guests. Approximate retail value: $30,000.
FOR GRAND PRIZE: Trip is subject to availability and other restrictions. Winner and five guests must be able to travel on dates of March 4th – March 7th, 2007. If winner is unavailable at such time, prize will be forfeited in its entirety without compensation of any kind. Ground transportation between the airport and the Montana ski mountain will be arranged and is included as part of the prize. If winner is accompanied by less than five guests on trip, prize elements will only be awarded in amounts appropriate for actual number of travelers; and, in such event, winner will NOT receive any compensation relative thereto. Winner and all guests must travel together on same itinerary as determined by Sponsor in its sole discretion. If guests are minors, they must travel with his/her parent/legal guardian on trip (i.e., the Grand Prize winner).
Approximately 15,000 official entry forms will be made available in-store nationwide, but odds of winning a prize depend on the total number of eligible entries received (both on-line and
in-store).
4. GENERAL CONDITIONS: All taxes on prizes and all expenses not specified herein associated with claiming/use/acceptance prize is the sole responsibility of the winner. Grand Prize winners must sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within 10 days of the date on documents. Guests of Grand Prize winner (if minor, his/her parent or legal guardian) must sign and return a liability release and where lawful a publicity release prior to the issuance of travel documents. Grand Prize winner and guests may also be required to sign additional documentation from the Montana Department of Commerce and/or the host mountain and/or to provide the Montana Department of Commerce and/or the host mountain with written authorization from a licensed physician as a pre-condition to taking trip. In the event of noncompliance with these requirements (as applicable), or if prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner selected from all remaining eligible entries received for drawing. By participating, entrant releases and agrees to hold harmless The North Face, Inc., The Montana Department of Commerce, Mariah Media Inc. and their respective parent, affiliates, subsidiaries, prize suppliers, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons and/or property arising from acceptance, possession, use/misuse of any prize or participation in this Sweepstakes. By accepting prize, where legal, winner grants to Sponsor the right to use the winner's name, picture, voice, likeness and biographical information for advertising/promotional/trade purposes, and any and all rights to such use, without additional consideration.
5. LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. Any use of robotic, automatic, macro, programmed or like on-line entry methods will void all such entries by such methods, and result in disqualification of any entrant using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, the on-line component of the Sweepstakes is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the on-line component of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the on-line component of the Sweepstakes and select the winners in a drawing from all eligible in-store entries received and all eligible on-line entries received prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted at www.thenorthface.com.
6. WINNERS LIST: For names of winners, mail a self-addressed, stamped envelope to Your Own Montana Mountain Sweepstakes Winners List, 301 S. Park Ave., Helena, MT 59620 by December 31, 2006.
